USER AGREEMENT – MAMIFY PLATFORM / CARDHOLDER TERMS
BETWEEN
Condividiamo Ltd, headquartered at Suite 23 Portland House, Glacis Road, Gibraltar, registered in the local company register, acting as the operator of the Mamify platform, hereinafter referred to as “Mamify” or “the Company”,
AND
The registered user, identified by the information provided during the sign-up process on the Mamify app, who makes purchases using a payment card, hereinafter referred to as the “User” or “Cardholder”.
1. PURPOSE OF THE AGREEMENT
1.1 This agreement governs the use of the Mamify digital
platform by the User, specifically for the purchase of products and
services using a credit/debit card or other supported payment
methods.
1.2 Mamify operates as a marketplace, allowing
Users to purchase goods and services provided by
third-party sellers (hereinafter the
“Sellers”).
2. TERMS OF USE
2.1 The User accesses the platform via the mobile app and
creates a personal account.
2.2 The User may purchase products and services offered by Sellers
registered on the platform.
2.3 Payments are processed via the authorized payment
service provider (Nuvei), and funds are distributed
between Sellers and Mamify according to internal commercial
agreements.
2.4 The User is responsible for the accuracy of the data provided,
including payment details, contact information, and tax data.
3. RESPONSIBILITIES AND WARRANTIES
3.1 Mamify is not the direct seller of any
product or service purchased through the platform.
3.2 All responsibility regarding: product quality, compliance,
shipping, returns, refunds, warranties, or post-sale support lies
exclusively with the Seller.
3.3 Mamify monitors Sellers according to its compliance standards
and may intervene in case of complaints or violations of platform
policies.
4. PAYMENTS AND SECURITY
4.1 All payments are handled by an authorized provider compliant
with PCI DSS standards.
4.2 Mamify does not directly store sensitive cardholder data.
4.3 In the event of chargebacks, disputes, or
refunds, Mamify acts as a technical
intermediary between User and Seller, without assuming
direct liability.
5. REFUNDS AND CANCELLATIONS
5.1 Refund requests must be submitted to the Seller through the
appropriate section of the App.
5.2 Each Seller may define their own refund policy in accordance
with applicable laws.
5.3 The User may stop using the platform at any time, provided that
no pending obligations exist.
6. PERSONAL DATA PROTECTION
6.1 Personal data is processed in compliance with the GDPR and in accordance with the Privacy Policy available within the App.
7. AMENDMENTS TO THE AGREEMENT
7.1 Mamify reserves the right to amend these terms and
conditions.
7.2 Any changes will be communicated to Users at least 7 days in
advance and will take effect on the date specified in the
notice.
8. GOVERNING LAW AND JURISDICTION
8.1 This agreement is governed by the laws of Gibraltar.
8.2 Any disputes arising from this agreement shall fall under the
exclusive jurisdiction of the courts of Gibraltar, unless otherwise
mandated by applicable consumer protection laws.
Read, understood, and digitally accepted by the User upon registration within the Mamify app.
